Office Hours Terms

The short version

If you're not comfortable with this, please don't use Office Hours.

1. Agreeing to these terms

By using Office Hours (the app and its websites, "the Service"), you agree to these Terms and to the Privacy Policy. If you don't agree, don't use the Service.

2. What the Service is

Office Hours lets you tell a short list of people you choose that you're free to talk, so one of them can call you. It is an independent, non-commercial beta made and run by an individual, not a company. It's free, it has no legal team, and it runs on a best-effort basis. It may change, break, or shut down at any time, with or without notice.

3. Who can use it

You must be at least 18. The Service is not offered in the European Union, the European Economic Area, the United Kingdom, or Switzerland, and you may not use it from there.

4. How you use it

5. Not for emergencies

Notifications can be late or never arrive, and nobody may claim your office hours. Never rely on Office Hours to reach someone in an emergency. Office Hours is not 911. It is barely a phone app.

6. Your risk

You use the Service at your own risk. That includes the risk of lost data, outages, missed or late notifications, the Service shutting down, someone getting into your account, and anything that happens on a call you make or take, including the risk that your friend picks up and wants to talk about their fantasy league for forty minutes.

7. No warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICE WILL MEET YOUR NEEDS, WORK WITHOUT INTERRUPTION OR ERRORS, BE SECURE, OR THAT PROBLEMS WILL BE FIXED.

8. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, OFFICE HOURS AND THE PERSON WHO RUNS IT ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, OR GOODWILL, WHATEVER THE LEGAL THEORY, EVEN IF WARNED THAT THEY COULD HAPPEN. TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO WHAT YOU PAID TO USE THE SERVICE, WHICH IS ZERO DOLLARS.

AND WHILE WE'RE ON THE SUBJECT OF "WHATEVER THE LEGAL THEORY": BY USING THE SERVICE, YOU AGREE TO HOLD ENTIRELY HARMLESS THE SERVICE, ITS AUTHOR, THE AUTHOR'S HEIRS AND ASSIGNS, THE AUTHOR'S HOUSE PLANTS, THE AUTHOR'S NEIGHBOR, AND THE AUTHOR'S FRESHMAN RA, SAM ECCLESTON, UNDER ANY AND EVERY THEORY OF LAW, PRESENT AND FUTURE, KNOWN OR NOT YET THOUGHT UP. THIS INCLUDES COMMON LAW, CIVIL LAW, CRIMINAL LAW, CONTRACT LAW, MARITIME LAW, CANON LAW (BOTH THE 1917 AND 1983 CODES), ETERNAL, NATURAL, HUMAN, AND DIVINE LAW (PER AQUINAS), BLUE LAWS, LEMON LAWS, HOFSTADTER'S LAW, THE LAW OF LARGE NUMBERS, ALL THREE LAWS OF THERMODYNAMICS, THE UNWRITTEN RULES OF THE GROUP CHAT, AND LA LAW (ALL EIGHT SEASONS AND THE 2002 REUNION MOVIE). IF SOMEONE INVENTS A NEW KIND OF LAW, IT'S COVERED TOO.

IF YOU THINK WE ARE KIDDING, WE ARE NOT KIDDING. BY ELECTING TO USE THIS APP, YOU WAIVE ALL RIGHTS TO SUE ANYONE ASSOCIATED WITH OFFICE HOURS, NOW AND FOREVER. IF CALIFORNIA PASSES THE "CALIFORNIA LAW CREATING EXTREME FINANCIAL LIABILITY FOR EXPERIMENTAL MOBILE APPS THAT HELP YOU CALL YOUR FRIENDS" ACT OF 2027, YOU EXPRESSLY WAIVE THE RIGHT TO TAKE ACTION UNDER IT BY AGREEING TO USE THIS APP.

9. Indemnification

You agree to defend and hold harmless Office Hours and the person who runs it from any claims, losses, and costs (including ALL attorneys' fees) that come from your use of the Service, your breaking these Terms, or your violating someone else's rights.

10. Ending your use

You can stop using the Service and delete your account at any time. Deleting your account may or may not fully erase every copy of your data across backups, logs, and the like. Again, we're quite good at this and we're not trying to fool you, but Andy worked at Amazon and can attest that IT IS HARD to run a highly available service with good disaster recovery that ALSO fully and completely deletes every copy of a record under deletion. By using the Service, you expressly agree that it's OK if we accidentally keep your data in a debugging log or a database backup even after you press the delete button, because life is busy, and formal verification of data under deletion is a non-trivial problem that one guy making an app after his kids go to bed may or may not get right.

We can suspend or remove any account, or end the Service, at any time and for any reason, including no reason, or a bad one.

11. Changes

We may update these Terms. We'll change the date at the top when we do. If you keep using the Service after that, you accept the new Terms.
